ACKNOWLEDGEMENT OF MEDIATION  

 

I/WE understand that the mediator assigned to my case will serve as a neutral person to help resolve the dispute.  The mediator will not act as an attorney or advocate for any party.  The mediator does not have the power to impose or enforce the terms of the agreement on any party. I/We understand that the mediation session is strictly confidential.  No party shall be bound by anything said or done in mediation unless a settlement is reached.  If a settlement is reached, the agreement shall be reduced to writing and, when signed, shall be binding upon all parties to the agreement.  Each party agrees not to request that the mediator testify against the other party, nor ask the mediator or the other party to testify regarding statements made in mediation.  Recording devices are not permitted in mediation. I/We understand that an attorney may review any agreement reached in mediation or that the parties may seek legal advice at any time, if necessary.  My signature acknowledges that I have read and understand this statement.
