Service fees are set by the County Board, shall be pre-paid and are non-refundable.   The Sheriff’s Office requires 2 (Two) copies of each document to be served (plus a copy for each additional person to be served if more than one).

Fee Schedule:

$100.00 - for each person to be served (including those that live at the same address). This covers up to 3 attempts of service, including mileage. See below for fees regarding Writs.

*Additional fees may be required for seizure of property to include but not be limited to tow charges and deputy stand by time.  This will be determined on a case by case basis.  These fees are also to be pre-paid and are non-refundable.  Please call 715-839-5160 for questions or clarification.

Effective 01/01/2019 – fees for Writ of Restitution, Writ of Replevin and Writ of Assistance have increased to $100.00. This fee remains the same despite if there are multiple people listed on the Writ.

For Writ of Restitution and Writ of Assistance, it is the policy of the Eau Claire County Sheriff’s Office to allow the tenant/occupant 72 hours to vacate the premises.   After that time, a deputy will place the petitioner in possession of the residence.   The petitioner is required to have made previous arrangements should a locksmith and/or mover be required. Our policy is to typically serve the defendant the writ and eviction notice on a Friday and set up a time with the petitioner to execute the eviction on a Monday

Writ of Replevin -  Writs for seizure of property MUST be accompanied by a bond of indemnity for 2X the value of the property AND must include specific detail of the item(s) to be recovered (ie serial #, model, VIN)  The Sheriff’s Office will not seize property pursuant to execution without proof of ownership.

$150.00 - prepaid and non-refundable for the posting and conducting the sheriff sale.  ($75 for posting plus $75 for the sale).

Foreclosure notices are posted in the main lobby of the Eau Claire County Courthouse at 721 Oxford Avenue.   They are also posted on the Sheriff’s Office website and in the municipality where the property is located.

Notices must be posted at least 20 days prior to the sale date.
